Waiver of Liability and Hold Harmless Agreement

By Making Payment You Are Accepting and Agreeing to These Terms & Conditions

I hereby release, waive and discharge the right to seek medical reimbursement or the legal prosecution of Aloha Mobility Scooter Rentals LLC. For any physical injury resulting in or property damage from the use of the rental equipment provided by Aloha Mobility Scooter Rentals LLC. I agree to be the sole person driving the rental scooter and I am fully responsible for any person/s who, with or without my consent, sit, stand, or ride the mobility scooter.

Customers understand and voluntarily assumes all risk associated with the use and operations of the equipment, including but not limited to falls, collisions, tipping, uneven surface, mechanical failure, weather conditions and third-party actions, whether foreseeable or unforeseeable.

I Hereby indemnify and hold harmless Aloha Mobility Scooter rentals LLC., Its owners, employees, agents and affiliates from any and all liability, loss, damage, expense (including attorney’s fees) ,cause of action, suits, claims, or judgements arising out of or related to injury or death of any person or damage to property of any nature whatsoever, resulting from the actual or alleged presence, use, possession, or operation of equipment, except to the extent such injury, death, or property damage is directly and solely caused by the negligence of

Aloha Mobility Scooter Rentals LLC. It is my express intent that this Release and Hold Harmless Agreement shall bind my family if I am alive and my heirs, assigns and personal representative ifI am deceased. It shall be deemed as a release, waiver, discharged, and covenant not to sue Aloha Mobility Scooter rentals LLC. Independent contractors, office agents, employees, and affiliates.

I Authorize Aloha Mobility Scooter Rentals LLC. To charge my credit/Debit card in the amount of my rental, and I Furter authorize additional charges after rental for damages, loss, theft, any missing equipment, late return and cleaning.

Cancellation Policy

Customer must call in cancellation request within 24 hours prior to rental delivery time to Aloha Mobility Scooter Rentals LLC. 808-386-3797 and receive conformation and refund.

I understand that I am fully responsible for the scooter during the rental period and any damage or loss incurred while in my possession and I guarantee have provided accurate height and weight information to assure proper use and performance of the scooter I’m renting.

I am 21 years old or older and I have received instructions from the rental agent on how to fully operate the scooter. I fully

I fully understand that the scooter must be off before entering or exiting off the scooter/equipment.

I fully understand that this is a one-person scooter with a limited weight capacity and it my responsibility not to exceed that limit.

I fully understand that I am not allowed to operate the scooter being under the influence of alcohol or drugs.

I fully understand that I am not allowed to use scooters on stairways, escalators, grass, sand, going through water or off-road use. I will immediately notify our company should the scooters have any issues or it breaks down. I will not abandon scooter/equipment at any time, I am held fully responsible for scooter until it is returned. I will follow all local laws and/or hotel and property rules.

I fully understand that the scooters/equipment are not to be loaned, sub-leased, or transfer of possession is not permitted.  All equipment must be returned to the original pick-up or delivery locations, unless prior arrangements have been approved. All equipment may not be taken out of the Las Vegas area without a written consent.Customer will not transport scooters in any vehicle.

I understand that should Equipment be Lost, stolen, damaged the Customer accepts full responsibility for the replacement cost and/or the repair. And there will be a $50 late fee charge at time of pick-up. Charges will be applied to the credit/debit card. (see charges Below)

Scooter Rentals LLC. Renter shall pay any legal fees incurred Aloha Mobility Scooter Rentals. LLC. to obtain Monies owed by the renter.

Customer Responsibility

I hereby agree to take sole responsibility for any damages outside of normal wear and tear of mobility scooter/ equipment including accessories, such as battery charger and key while in my possession. My possession starts when I receive the rental scooter/equipment and ends when scooter/equipment is returned.

When returning scooter/equipment it is customers responsibility to return all items included with scooter/equipment. Such as keys, chargers, user manual and/or other accessories rented. Do not leave any rented equipment unattended until fully returned and confirmed by Staff of Aloha Mobility Scooter Rental LLC. Failure to report, return or safeguarded scooter and any equipment associated with rental while in your possession will constitute as Neglect and you will be responsible for the replacement of scooter/equipment loaned or rented to you by Aloha Mobility Scooter Rentals LLC.

I Authorize Aloha Mobility Scooter Rentals LLC. To charge my credit/Debit card for the cost of the Equipment charges due to seizures or removal of equipment by any local authorities, or should equipment be lost, stolen, damaged or missing parts and equipment.

Approximate Cost Replacement Parts and Repair

Scooter Replacement:                                                 $1,500 - $3,000

Lost or Broken Charger:                                              $80 - $250

Snapped or broken key in the ignition:                   $35 - $85

Lost cracked or broken front shroud:                       $50 - $250

Lost cracked or broken rear shroud:                         $50- -$250

Seat frame and mechanism, damage or broken:     $300 -$700

Seat vinyl cover:                                                            $50 - $100

Lost or damage seat armrest and pads each:          $30 - $120

Lost or damage front basket:                                     $40 - $80

Lost or damage rear basket:                                        $90 - $100

Broken or nonfunctioning horn:                                 $10 - $30

Broken or nonfunctioning battery power meter:     $100 -$120

Snap or nonfunctioning throttle lever:                       $25 - $35

Front or rear broken nonfunctioning lights:             $30 - $50

Agreement

By signing this agreement or purchasing VIA our online booking system or booking VIA Phone,you hereby agree to the terms and conditions set forth by Aloha Mobility Scooter Rentals LLC. WE will not tolerate vandalism against the company property and we will report all criminal behaviors to the proper authority, and all unpaid debt to collection agencies. Renter shall pay any legal fees incurred Aloha Mobility Scooter Rentals. LLC. to obtain Monies owed by the renter.

This agreement shall be governed by the Laws of the State of Nevada
